Welcome to FiwiWeb Services! These Terms and Conditions (the “Terms”) govern your use of our website, fiwiweb.com, and the services provided by FiwiWeb Services (referred to as “we,” “us,” or “our”). By accessing or using our website and services, you agree to comply with and be bound by these Terms.
Our “Partner Plan” is a managed design and hosting subscription designed specifically for Caribbean small businesses.
Ownership of Content: The Client retains full ownership of all text, logos, and images provided for the website build.
Design Ownership & Buyout: While the subscription is active, the website design and its technical environment are managed and licensed by FiwiWeb Services.
The 24-Month Milestone: If you wish to cancel your subscription and move your website design to another host within the first 24 months, a one-time “Design Buyout Fee” applies to cover initial labor costs. After 24 months of continuous service, this buyout fee is waived, and the design is yours to move freely.
Cancellation Notice: We require a 30-day written notice for the cancellation of any Design Subscription.
Pre-payment & Terms: All accounts are established on a pre-pay basis. Your billing cycle corresponds to the contract length initially selected at setup (e.g., monthly, 3-month, 6-month, or annual).
Promotional Term Billing: If you subscribe to a multi-month promotional plan—such as receiving the first month free with a 3, 6, or 12-month commitment—the plan is billed as a single pre-paid block for the remainder of the term at the time of purchase.
Renewal Notices: We will email renewal notices no later than seven (7) days before the actual renewal date associated with your account.
Automatic Payments: If you have a credit/debit card on file and have authorized automatic payments, your card will be charged on the due date.
Late Fees & Suspension: If payment is not received within seven (7) days of the due date, a late fee will be added to the account. Standard hosting accounts not brought current within seven (7) days of the notice are subject to service suspension.
Partner Plan Grace Period: For clients on a Managed Design Subscription (Partner Plan), we provide a 14-day grace period before suspension to ensure business continuity.
Responsibility for Fees: You are responsible for all fees owed on the account from the time it was established until the time you formally notify us via the client portal or email to request termination of services.
Automatic Renewal: Your account will automatically renew at the original contract length unless canceled prior to the renewal date.
Price Changes: We reserve the right to change prices at any time, unless other specific terms have been agreed upon in writing.
Refundability: Monthly and annual payments are non-refundable once the 30-day money-back guarantee has passed or if your account is terminated due to a failure to comply with our Terms of Service or Acceptable Use Policy.
Daily Remote Backups: As a core feature of our service, we perform daily remote backups of your website data. We maintain a rolling 3-day archive of these backups to protect against data loss.
Client Responsibility: While we strive for 100% data integrity, you agree to maintain a current local copy of all content hosted by us as a secondary precaution. FiwiWeb shall not be held liable for data loss beyond our most recent successful backup.
Fees and Renewals: You must pay for domain registrations or transfers prior to their effectiveness. All domain-related fees are strictly non-refundable.
Ownership: You retain full ownership of any domain registered through us, provided your account is in good standing.
Transfers: The success of a domain transfer is your responsibility; we are not liable for failures due to registrar locks or incorrect contact information.
30-Day Window: Our shared hosting services include a thirty (30) day money-back guarantee for first-time accounts. If you cancel within the first thirty (30) days of your term, you may receive a full refund of basic hosting fees upon written request.
Promotional and Multi-Month Terms: If you subscribed to a 3, 6, or 12-month term and received a “First Month Free” promotion, a refund for the remaining months of the term is not guaranteed once the initial 30-day money-back period has passed.
Non-Refundable Items: The costs of domain names, third-party licenses, administrative fees, and custom software installation fees are strictly non-refundable. If your sign-up included a “Free Domain,” the standard cost of that domain will be deducted from any eligible hosting refund.
Eligibility: This guarantee applies only to first-time accounts; returning customers or those opening additional accounts are not eligible for a refund.
Request Process: To exercise this guarantee, a formal refund request must be submitted via our online ticketing system within the 30-day notice period.
AUP Incorporation: Your use of our services is strictly governed by our Acceptable Use Policy, which prohibits illegal content, resource abuse (such as crypto-mining or unauthorized AI scraping), and spam.
Security Precautions: You are responsible for maintaining the confidentiality of your account credentials. We strongly recommend enabling Multi-Factor Authentication (MFA) in your account for added security.
We may offer products and services from third-party providers (e.g., specific software licenses or hardware). These are subject to the terms of the specific provider, and FiwiWeb Services is not liable for their quality or availability.
Force Majeure: FiwiWeb Services is not in default for service failures caused by events beyond our control, including natural disasters, internet-wide outages, or power grid failures.
Governing Law: This Agreement is governed by the laws of the State of Texas and applicable United States laws.
We may revise these Terms at any time by posting an updated version on our website. Your continued use of our services constitutes acceptance of the updated Terms.
